Terms of Service
AIRLUMN Live Experiences, LLC
TERMS OF SERVICE
These Terms of Service (the “Terms”) govern access to and use of the AIRLUMN website, application, platform, live and on-demand experiences, automated Guide, events, memberships, subscriptions, and related services (collectively, the “Service”). By creating an account, accessing the Service, or making a purchase, you agree to these Terms.
1. Company and Contact Information
AIRLUMN Live Experiences, LLC (“AIRLUMN,” “we,” “us,” or “our”) operates the Service. Legal notices should be directed to P.O. Box 584, White Plains, MD 20695 General support: support@airlumn.app Privacy inquiries: privacy@airlumn.app.
2. Eligibility and Age Requirement
AIRLUMN is intended for adults. Unless AIRLUMN expressly states otherwise for a particular feature and implements the additional safeguards required by applicable law, you must be at least 18 years old to create an account or use the Service. AIRLUMN may require age verification. You may not create an account using false age information.
3. Electronic Contracting and Assent
When you select an affirmative agreement control such as “Create account,” “I agree,” or a purchase button that clearly states the contractual consequence, you agree to the Terms and acknowledge the Privacy Policy. AIRLUMN may maintain records of the version presented, date and time of assent, account or session, and related technical information reasonably necessary to establish the transaction or acknowledgment.
The Terms, Privacy Policy, applicable Community Rules, Refund & Cancellation Policy, and any purchase-specific terms are incorporated into your agreement with AIRLUMN to the extent applicable.
4. Description of the Service
AIRLUMN provides entertainment and empowerment experiences that may include reflective, emotional, spiritual, educational, self-development, or community-oriented content. Some experiences are automated and may use artificial intelligence or other automated technologies.
5. No Medical, Mental-Health, Legal, Financial, or Emergency Services
AIRLUMN is not a medical provider, mental-health provider, therapist, counselor, crisis service, emergency service, attorney, financial adviser, or other professional-care provider. AIRLUMN does not provide diagnosis, treatment, therapy, counseling, clinical assessment, clinical monitoring, risk assessment, or emergency response.
Content and automated Guide interactions are not individualized professional advice and are not a substitute for qualified professional care. Do not rely on AIRLUMN to make medical, mental-health, legal, financial, safety, or other professional decisions.
6. Automated Guide and Artificial Intelligence
The automated Guide is software, not a person. Automated outputs may be incomplete, inaccurate, inappropriate, or unavailable. The Guide is not a clinician, therapist, counselor, crisis responder, or emergency service. You remain responsible for deciding whether and how to use any output.
AIRLUMN may use automated systems to identify language that signals a possible crisis solely to trigger the refer-only safety response described in the Crisis/Safety Notice and Privacy Policy. This process is not a clinical or medical assessment.
7. Crisis and Safety Response
AIRLUMN maintains an always-available crisis-help control during applicable experiences. If an automated Guide interaction triggers the crisis-referral flow, the Guide will stop the experience, present the approved referral language and available resources, encourage the user to contact a trusted person when appropriate, and stop.
AIRLUMN does not promise to identify every crisis, assess crisis severity, contact emergency services, contact a trusted person, or take physical-world action on your behalf. Third-party resources are independent of AIRLUMN.
If you are in immediate danger, contact the emergency service available where you are located. In the United States, you may call or text 988 for the Suicide & Crisis Lifeline.
8. User Accounts and Security
You are responsible for maintaining the confidentiality of your credentials and for activity occurring through your account, except to the extent caused by AIRLUMN’s failure to use reasonable security measures. Notify AIRLUMN promptly of unauthorized access or suspected compromise.
9. User Content
You retain ownership of content you submit, including declarations, messages, comments, recordings, images, or other materials (“User Content”), subject to the rights granted below.
You grant AIRLUMN a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, moderate, secure, and otherwise use User Content only as reasonably necessary to operate, provide, secure, maintain, support, improve features you request, enforce these Terms and Community Rules, protect users and the Service, and comply with law. This license ends when the content is deleted from active systems, subject to limited copies retained for backup, security, fraud prevention, dispute resolution, legal compliance, or preservation.
AIRLUMN does not use the content of your declarations or Guide interactions that trigger a crisis response for targeted advertising.
10. User Representations
You represent that you have the rights necessary to submit your User Content and that your content and use of the Service will not violate applicable law, these Terms, the Community Rules, or another person’s intellectual-property, privacy, publicity, or other rights.
11. Community Rules and Moderation
You must comply with the Community Rules. AIRLUMN may use automated systems and human review to detect, restrict, block, remove, preserve, or otherwise act on content or accounts that may violate the Terms, Community Rules, applicable law, or reasonable safety standards.
Moderation, security review, or legal review is not clinical assessment or treatment. AIRLUMN does not promise that all prohibited, harmful, or concerning content will be identified or acted upon.
12. Intellectual Property
The Service, including its software, branding, designs, text, graphics, audio, video, features, and AIRLUMN-created content, is owned by AIRLUMN or its licensors and is protected by applicable intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, reverse engineer, scrape, or create derivative works from the Service.
13. Third-Party Services
The Service may link to or integrate with third-party services, including payment, hosting, analytics, AI, communications, crisis, wellness, or professional resources. Third parties operate independently unless AIRLUMN expressly states otherwise. AIRLUMN does not control the availability, content, quality, policies, or practices of independent third parties.
14. Purchases, Subscriptions, and Automatic Renewal
Before a purchase, AIRLUMN will present the material price and payment terms applicable to the transaction. For an automatically renewing subscription, the checkout disclosure will clearly identify the renewal frequency, renewal price or pricing method, and cancellation method.
A subscription will renew automatically only if you affirmatively consent to the renewal offer. AIRLUMN will provide a simple, cost-effective, timely, and easy-to-use cancellation mechanism that does not unreasonably delay, hinder, or obstruct cancellation. Cancellation stops future renewal charges but does not automatically refund amounts already paid except as required by the Refund & Cancellation Policy or applicable law.
Maryland automatic-renewal requirements apply to covered offers. AIRLUMN will not rely on this section as a substitute for the required checkout disclosures and cancellation functionality.
15. Refunds and Cancellations
Refunds and purchase cancellations are governed by the Refund & Cancellation Policy and any purchase-specific terms displayed before payment. Nothing in those policies limits a right or remedy that cannot lawfully be waived.
16. Suspension and Termination
AIRLUMN may suspend, restrict, or terminate access where reasonably necessary to enforce these Terms or Community Rules, address security or abuse, protect users or AIRLUMN, comply with law, or discontinue a Service. Where reasonably practicable, AIRLUMN may provide notice of termination and any available review process.
You may stop using the Service at any time and may request account deletion as described in the Privacy Policy.
17. Privacy
AIRLUMN’s Privacy Policy describes the categories of personal data collected, purposes of processing, sensitive-data practices, automated Guide processing, service providers, retention, security, consumer privacy rights, and deletion procedures.
18. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. AIRLUMN DISCLAIMS WARRANTIES NOT EXPRESSLY REQUIRED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AIRLUMN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT AUTOMATED OUTPUTS WILL BE ACCURATE OR COMPLETE.
Nothing in these Terms excludes or limits liability or a consumer right that cannot lawfully be excluded or limited.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRLUMN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRLUMN’S AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID AIRLUMN FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
20. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless AIRLUMN and its officers, directors, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Service, violation of these Terms or Community Rules, or infringement of another person’s rights.
21. Governing Law and Venue
Unless applicable law requires otherwise, these Terms are governed by the laws of the State of Maryland without regard to conflict-of-law principles. Any permitted court proceeding relating to these Terms shall be brought in a state or federal court with appropriate jurisdiction in Maryland, unless applicable law provides otherwise.
22. Dispute Resolution
Unless AIRLUMN later adopts a separate arbitration agreement presented with appropriate assent, disputes will be resolved in a court of competent jurisdiction subject to applicable law. Nothing in these Terms waives a right that cannot lawfully be waived.
23. Changes to the Terms
AIRLUMN may update these Terms when reasonably necessary to reflect changes in the Service, law, security practices, or business operations. For material changes, AIRLUMN will provide reasonable notice before the change becomes effective where required or appropriate. The updated Terms will identify the effective date. If a material change materially affects your rights, AIRLUMN may provide an opportunity to terminate affected paid services before the change takes effect.
24. Miscellaneous
Severability. If a provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect.
No Waiver. Failure to enforce a provision is not a waiver of future enforcement.
Assignment. You may not assign these Terms without AIRLUMN’s consent. AIRLUMN may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, subject to applicable law.
Survival. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnification, dispute provisions, and legal compliance provisions—survive termination.
Force Majeure. AIRLUMN is not responsible for delay or failure caused by events beyond its reasonable control, except where prohibited by law.
Entire Agreement. These Terms, the Privacy Policy, Community Rules, Refund & Cancellation Policy, and applicable purchase-specific terms constitute the agreement concerning the Service.
